Chapter 217 of the Seaside Heights Borough Code

Boardwalk & Ocean Beach NO FLY ZONE is in effect.

North Bayfront: Drone flights are permitted to and from any part of the beach that is located between a point beginning fifteen feet (15') south of the designated public swimming beach and ten feet (10') north of the boat ramp, but not from or upon the public docks.

South Bayfront: Drone flights are permitted to and from any part of the beach that is located south of the public dock, but not from or upon the public dock.
All drone flights, when permitted by the Borough Code, are required to comply with FAA regulations. This means that non-recreational flyers must possess a Part 107 remote pilot license and recreational flyers must pass the aeronautical and safety test provided by the FAA. You are required to show your Part 107 remote pilot license or TRUST certificate of completion to law enforcement upon request.
It is unlikely that most types of recreational and hobby drone flights can be conducted in Seaside Heights under FAA regulations and, therefore, most drone flights will be conducted under Part 107.
The Borough Code grants the Borough Administrator authority to issue a local waiver from the time and location restrictions when the applicant establishes that the flight will be conducted in conformance with the requirements of the FAA regulations, including without limitation the operating rules and remote pilot certification rules, and in a manner that will not cause unreasonable risk of endangering the life or property of another, in the sole judgment of the Borough Administrator. Contact the Borough Administrator directly if you wish to file a waiver application.
